The Burt County Board of Supervisors met in regular session on Tuesday, May 12, 2015 in the Boardroom of the Burt County Courthouse in Tekamah, Nebraska, pursuant to adjournment of their last meeting. Notice of the meeting was given in advance thereof by Publication in the Plaindealer, upon a 1st floor bulletin board within the courthouse and on the County’s Website. A copy of the proof of publication is on file in the office of the County Clerk. The following members were present: Cliff Morrow, David Schold, Greg Brummond, Matt Connealy, Perry Rogers, Ted Connealy and Gerald Newill.

The meeting opened at 9:00 A.M. upon motion by Rogers, seconded by Schold, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays-none. Chairman Morrow informed the public that the Nebraska Open Meeting Act was posted on the wall.

Upon motion by Schold, seconded by Newill, the agenda was approved, with roll call vote as follows: Ayes –Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays-none.

The County Clerk Report of Fees, the County Court Report of Fines, the District Court Fee Report and the Zoning Report for April, were approved upon motion by M.Connealy, seconded by Rogers, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

The minutes of the last meeting were approved upon motion by Schold, seconded by Newill, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

The following Miscellaneous Receipts in the amount of $927,624.94 and fund balances were approved upon motion by M.Connealy, seconded by T.Connealy, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

A Summary from the Tax Equalization and Review Commission, showing the levels of value of real property in Burt County for tax year 2015, was noted and placed on file.

Jon Roberts representing NACO Benefits Services presented Group Medical Benefit comparisons and NACO Benefits Services information to the Board. Health Insurance renewals are July 1, 2015. The Board will review the options and make their decision at the May 29, 2015 meeting.

Brummond moved to approve a claim for Brenneis Insurance that got left off of the payment run from the April 30, 2015 claims. Motion was seconded by T.Connealy, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

On motion by M.Connealy, seconded by Rogers, the Board voted to accept Fred Mytty’s proposal to do the County’s budget for 2015-2016 in the amount of $3,200.00 plus mileage, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

Upon motion by Schold, seconded by Newill, the Board approved a Special Designated Liquor License for Ronnie’s Bar to have a beer garden at the rodeo grounds in Tekamah on June 5 and June 6, 2015, for the Rodeo, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

At 09:47 A.M. Chairman Morrow opened the public hearing to establish permissible hours for the sale at retail and dispensing of alcoholic liquors, including beer, wine and spirits on Sundays within Burt County but outside the corporate limits of cities or villages. After discussion and with no public comment, the Chairman declared the public hearing closed at 09:50 A.M., and the Board went back into regular session.

Board Member Schold offered the following resolution and moved for its adoption:

RESOLUTION # 2015-04

WHEREAS, Neb.Rev.Stat. § 53-179, establishes the permissible hours for the sale and dispensing of alcoholic liquors, including beer, wine and spirits, by licensees within the State of Nebraska, and

WHEREAS, Neb.Rev.Stat. § 53-179 (2) authorizes this Board to establish permissible hours for the sale at retail and dispensing of alcoholic liquors, including beer, wine and spirits on Sundays within Burt County but outside the corporate limits of cities or villages;

WHEREAS, it is the desire of this Board to establish uniform hours for the sale at retail and dispensing of alcoholic liquors, including beer, wine and spirits, by licensees within Burt County but outside the corporate limits of cities or villages on Sundays.

WHEREAS, published notice and public hearing was held on May 12, 2015, to consider changing the hours of liquor sales on Sunday in Burt County.

NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of Burt County, Nebraska, that subject to the provision of all applicable State and Federal Laws, the permissible hours for the sale at retail and dispensing of alcoholic liquors, including beer, wine and spirits, by licensees within Burt County, but outside the corporate limits of cities and villages, shall be as follows:

At 10:00 A.M. Highway Superintendent Peggy Smith opened the following bids for Bridge materials for C001103010 & C0011022220.

M.Connealy moved to accept the bid from Midwest Sales & Services, Brummond seconded the motion, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

Travis Mann with Luxa Construction visited with the Board and Road Superintendent Smith about the completion of CVA Road project. The project has come to a stop due to questions/concerns regarding the RR right of way. Members of the public, Roger Moderow and Roland Richards, spoke in regards to concerns of this road/RR right of way as well. All agreed work needs to start back up as soon as representatives from the RR can be consulted about the concerns of the work within their right of way.

Superintendent Smith shared quotes for asphalt patching for various county roads. She reported the work could start in June. Not wanting to do intersections work at this time, the board advised Peggy to get new patch bids without the intersections being quoted in.

Board Member M.Connealy offered the following resolution and moved for its adoption:

RESOLUTION # 2015-05

A RESOLUTION ADOPTING A PAYROLL CONVERSION PLAN

WHEREAS, it has come to the attention of the Burt County Board of Supervisors that a new Nebraska Law (Neb. Rev. Stat. §48-1230 – 2014 Neb. Laws, LB 560, Sec. 4( 2)) has been adopted where the employee’s wage statement (nonexempt employees) requires the number of hours for which an employee is paid be on the employee’s wage statement, hereby also requiring paying employees per hours worked (paying hourly, no longer salary).

WHEREAS, the Burt County Board of Supervisors have come to the opinion that Neb. Rev. Stat. §48- 1230 cannot be complied with unless the pay day is after the pay period has been completed. WHEREAS, the Burt County Board of Supervisorsdesire to make a payroll conversion plan where the pay period would be from the 22nd day of the month to the 21st day of the next month and the pay day would continue to fall within the last week of the month.

WHEREAS, the Burt County Board of Supervisors desire to allow its employees compensatory time to cover the reduction of pay the employees will receive during the first month’s adjustment period.

NOW THEREFORE BE IT RESOLVED THAT THE BURTCOUNTY BOARD OF SUPERVISORS
HEREBY APPROVE AND ADOPT THE PAYROLL CONVERSION PLAN, WHICH AFFECTS ALL EMPLOYEES WHO WORK IN COUNTY DEPARTMENTS.

There was a motion by Newill to go into Executive Session for the protection of the public interest to discuss litigations with Co.Attorney Frank Barron and Kevin Brenneis from Brenneis Ins. Agency., motion was seconded by Rogers, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none. Chairman Morrow declared the meeting entered into Executive Session at 10:45 A.M. for

the protection of the public interest to discuss pending litigations. M.Connealy motioned to come out of executive session, Newill seconded, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none. Chairman Morrow declared the meeting was back into Regular Session at 11:03 A.M. No action was taken during executive session.

The Road Committee gathered and presented information for a new tractor. After reviewing the various options, it was decided to look further in the direction of a lease. Next meeting they’ll bring 3 year lease options of comparable tractors for review and possible action.

There being no further business to come before the Board at this time, the meeting adjourned at 11:47 A.M. until 9:00 A.M., May 29, 2015.

The following claims for April in the amount of $608,732.91 including $102,853.33 for payroll, were read, audited, warrant drawn and checks generated on the respective funds on motion by M.Connealy, seconded by Schold, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none. $200,000.00 of this total reflects a transfer from the General Fund to the Road Fund.

At 10:02 A.M. Chairman Morrow opened the public hearing regarding a permit for a Verizon Wireless (Cellco Partnership) Cell Tower on County Road 13, North & East of

Lyons, Legal Description being a parcel in the N 1⁄2 SW 1⁄4 and N 45 acres of SE 1⁄4 of 20-23- 9. Chad M. Skinner with NEVCO, Inc. and Scott Lindstrom the landowner were present to answer questions. After discussion, the Chairman declared the public hearing closed at 10:10 A.M., and the Board went back into regular session.

Motion was made by Newill to approve the conditional use permit for Cellco Partnership dba Verizon Wireless. Brummond seconded the motion, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

Road Superintendent Peggy Smith presented Quinnebaugh Township’s maintenance agreement with Burt County. After discussions, M.Connealy made a motion to approve the agreement with a change from $60.00 per hour to $75.00 per hour, after no seconds were heard, the motion died. Schold then made a motion to approve the agreement with a change from $60.00 per hour to $90.00 per hour, and the motion was seconded by T.Connealy, with roll call votes as follows: Ayes- Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays –none.

Discussions were held regarding a countywide problem of hard surface returns at County Roads. The issue being, these areas in need of repair lay within the State’s R.O.W. The overall question… who fixes these Road issues; does the County have the right to infringe upon the State’s ‘property’, the State will not fix the issues upon request. The Board wants better road conditions for the constituents. County Attorney, Frank Barron, will draft a letter to Attorney General asking for rights to be granted for the County to work within the State’s right-of-way.

Brad Slaughter with Ameritas Investment Corp. presented the Board with the most current information on the Highway Allocations Bonds. The Bonds will be callable on 7- 27-2015, No action was taken at this time.

The Board discussed the pros and cons of approving ‘10 hour days’ for the Road Department. Peggy Smith, Road Superintendent and Foreman, Mike Braniff were present and spoke in support of the 10 hour days in regards to work efficiency. Brummond made a motion, Schold seconded for: four -10 hour days (Mon-Tues & Thurs-Fri, with Wednesday being the day off), the schedule running May 1-Sept. 30, roll call vote as follows: Ayes – Brummond, Schold. Nays-Morrow, M.Connealy, Rogers, T.Connealy and Newill. Motion Failed. T.Connealy made a motion, M.Connealy seconded for: four -10 hour days (Mon- Thurs. with Friday being the day off), the schedule running May 1-Sept.30, roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays-none.

Road Committee Report: No special requests/suggestions at this time. Various discussions to do with equipment, property nuisance clean up, Road work going on around the county. Next meeting the committee will have some equipment suggestions/recommendations.

There being no further business to come before the Board at this time, the meeting adjourned at 11:22 A.M. until 9:00 A.M., May 12, 2015.

Board Member Matt Connealy gave a brief update on the gas tax Legislation.

Chairman Morrow signed the Karr Tuckpointing Contract for Exterior Masonry Preservation, Maintenance and Repair of the Burt County Courthouse upon motion by M.Connealy, seconded by Rogers, with roll call vote as follows: Ayes –Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

Chairman Morrow signed the Thrasher Basement Systems Contract for a Radon Mitigation system to be installed in the Burt County Courthouse upon motion by Brummond, seconded by M.Connealy, with roll call vote as follows: Ayes –Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

The Burt-Washington Drainage District Annual Report for FY March 2014-February 2015 was noted and placed on file.

The Board received the Audit for Burt County for the year ending June 30, 2014, performed by Ritterbush & Piotrowski. Upon motion by M.Connealy, seconded by T.Connealy, the Board accepted and approved the audit, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

Upon motion by Rogers, seconded by Brummond, the board approved to sign a 3 year contract with Ritterbush & Piotrowski, LLP to do Burt County’s Audits for FY 2014- 2015, 2015-2016, 2016-2017, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

Kevin Brenneis presented his 2015 Annual Insurance Report and answered questions.

Marty and Becky Rocca visited with the Board in regards to some drainage issues. Mike Braniff, Road Foreman reported that ditches are dug and currently roads are being reworked in regards to the discussions with the visitors.

Upon motion by Schold, seconded by T.Connealy, the Board approved to form a payroll committee to help develop a plan to get Burt County in compliance with LB560, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.
The following people were appointed to be on the committee: Sarah Freidel, Peggy Smith, Frank Barron, Matt Connealy, Gerald Newill and Perry Rogers.

Brief discussions were held with Foreman Braniff on various Roads projects.

An opportunity to attend an Open Meetings Workshop was presented. Matt Connealy will attend, others have time to register before the June workshop if they so choose.

Peggy Smith presented information on LB 65. The Board had discussions on this bill in regards to Inactive Townships and the Taxation of those Townships. Quinnebaugh Township’s maintenance agreement was presented and discussed.

Chairman Morrow signed a lot split application for Margaret Nelson located in the NE 1⁄4 of Section 33 and the NW 1⁄4 of Section 34, all in Township 22 North, Range 9 East of the 6th P.M., Burt County, Nebraska.

Sheriff Robert Pickell presented information on cost and equipment involved with the new 911 system that is needed due to cell phone usage and technology changes. He offered insight on County budget concerns that happen within Sheriff’s departments that are beyond their control, i.e., the changing 911 technology and lack of funding for such systems, and the costs associated with the jailing/boarding of Burt County prisoners.

Pete Ueding came to the Board to identify some building maintenance needs: Bill Clark with Karr Tuckpointing presented a proposal for exterior building treatments. Dylan Henneman with Thrasher Basement presented a proposal for a Radon Mitigation System.

At 10:37 A.M. Chairman Morrow opened the public hearing regarding a new liquor license for Debra Rowe dba Way North Restaurant & Lounge. After discussion, the Chairman declared the public hearing closed at 10:41 A.M., and the Board went back into regular session.

Count Attorney Frank Barron presented information on an Interlocal opportunity with Cuming County for a Juvenile Diversion Program. Addisen Beck, program coordinator from Cuming County offered a more indepth explanation. The Board agreed this would be a beneficial program to participate in, upon motion by Schold, seconded by Newill, Chairman Morrow was given approval to sign the Juvenile Diversion Interlocal Agreement with Cuming County, with roll call vote as follows: Ayes-Morrow, Schold, Brummond, Rogers and Newill. Nays-none. Absent- M.Connealy and T.Connealy.

Upon motion by Schold, seconded by Newill, the Board approved a request to hold the annual National Day of Prayer Service on the courthouse grounds on May 7 at 12:00 P.M., with roll call vote as follows: Ayes – Morrow, Schold, Brummond, Rogers and Newill. Nays – none. Absent-M.Connealy and T.Connealy.

Upon motion by Newill, seconded by Brummond, the Board approved a Special Designated Liquor License for the Burt County Fair for August 7 through August 11, 2015, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, Rogers and Newill. Nays – none. Absent-M.Connealy and T.Connealy.

Patty Plugge from Burt County Economic Development gave an annual update of services and projects throughout Burt County that her office has been a part of and assisted with this past year. She also presented a 2015 Priorities Plan for the Burt County Economic Development District.

Upon motion by T.Connealy, seconded by Brummond, the Board approved a Special Designated Liquor License for L-TEN, LLC dba Pheasant Bonanza for a beer garden at their Warrior Dash Event on June 6, 2015, with roll call vote as follows: Ayes – M.Connealy, Schold, Brummond, Rogers and T.Connealy. Nays – none. Absent – Morrow and Newill.

Upon motion by Rogers, seconded by T.Connealy, the Board authorized Vice- Chairman M.Connealy to sign the letter to Ritterbush & Piotrowski regarding the audit they performed for Burt County on fiscal year 2013-2014, with roll call vote as follows: Ayes – M.Connealy, Schold, Brummond, Rogers and T.Connealy. Nays – none. Absent – Morrow and Newill.

Board Member Matt Connealy gave a report on LB609 Legislative Hearing he attended in Lincoln.

Road Superintendent Peggy Smith, Foreman Mike Braniff and the Board discussed possible equipment needs for Roads Dept. in the future. Smith reported that Midwest had presented an offer to buy the ‘old’ drag, the decision was to keep the old drag for now.

Attendance to the 2015 NACO Institute of Excellence was discussed. The Board approved to send two Burt County Employees. County Clerk Sarah Freidel will attend.

Attendance to the NE Nebr. Asso. Of County Officials 2015 Spring Workshop at Northeast Community College Lifelong Learning Center was discussed. County Clerk Freidel will submit registrations the end of February.

Upon motion by M.Connealy, seconded by Rogers, the Board appointed the following Planning Commission Members: Rodney Bromm, Jay Hovendick and Larry Larsen, with

Upon motion by Schold, seconded by Newill, the Board appointed the following Board of Adjustment Members: Rodney Bromm, Jon Ronnfeldt and Billy Riecken, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

Upon motion by M.Connealy, seconded by Rogers, the Board approved the removal of Marge Shumake and the addition of Sarah Freidel to be on the list of employees who can be requested to be added to the Grievance Board when a particular grievance has been submitted, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

The Road Committee reported that next meeting they will bring back recommendations to the Board in regards to the tractor and road maintainer that has been discussed in the past. Brummond from the Road Committee also opened brief discussions about a possible employee questionnaire being drafted. No action was taken.

At 9:45 Chairman Morrow opened the following bids for 2015 Lawn Treatment Applications.

Grounds and Maintenance Superintendent Pete Ueding and the Board reviewed the bids. Newill moved to accept the low bid with KB Lawn, T.Connealy seconded the motion, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers, T.Connealy and Newill. Nays – none.

Roland Richards and Roger Moderow came before the Board on behalf of Oakland Township. Questions were posed as far as maintenance responsibilities when it comes to ice removal on the newly paved County Road O (CVA Road). Being a Township Road, there are no changes with the maintenance responsibilities lying with the township.

Upon motion by M.Connealy, seconded by Rogers, – all voting Aye, Chairman Morrow opened the Public Hearing for the One and Six Year Road Plan at 10:30 am.

Melvin Schmidt and Mark Blackford came before the Board with concerns of road conditions in the area of CR C and CR 21. Concerns were expressed in regards to water drainage on roads around Schmidt’s property and poor road conditions for heavy truck traffic in and out of Craig Cattle Co. They asked for traffic count studies to begin and the County’s one and six year road plan to consider paving approximately 1 1⁄4 miles of CR 21.

Allen Soll and Brett Langley attended on behalf of the Tekamah Airport Authority. They asked for the one and six road plans to keep moving the plans up the list for getting a

route/road to the airport entrance paved.

Will Belfrage spoke in regards to a bridge Northwest of Tekamah.

Roland Richards asked about a bridge on CR O in Oakland Township. Superintended Peggy informed him that tubes for this bridge are already in the plans.

There being no further public comments, the Chairman Morrow closed the Public Hearing and returned to regular session at 11:00 a.m. upon motion by M.Connealy, seconded by Newill, all voting – Aye.

Board Member M.Connealy offered the following resolution and moved for its adoption:

WHEREAS,PURSUANT TO L.B.1302 OF THE80th LEGISLATUREOFTHE STATEOFNEBRASKA, A PUBLIC HEARING WAS HELD BY THE BURT COUNTY BOARD OF SUPERVISORS FOR THE PURPOSE OF DRAFTING A ONE AND SIX YEAR ROAD PLAN TO DESIGNATE SPECIFIC ROAD AND BRIDGE IMPROVEMENTS FOR BURT COUNTY ROADS .

WHEREAS , LEGAL NOTICE WAS PUBLISHED IN THE BURT COUNTY OAKLAND INDEPENDENT WHICH IS A LEGAL NEWSPAPER IN THE COUNTY.

BE IT FURTHER RESOLVED, THE ONE AND SIX YEAR ROAD PLANS WERE FULLY DISCUSSED BY THE HIGHWAY SUPERINTENDENT WITH THE COUNTY BOARD AND THOSE PRESENT.

NOW THEREFORE BE IT RESOLVED BY THE BURT COUNTY BOARD OF SUPERVISORS THAT THE ONE AND SIX YEAR ROAD PLANS FOR ROAD IMPROVEMENTS IN BURT COUNTY BE APPROVED AS PRESENTED BY THE HIGHWAY SUPERINTENDENT AND AS ADVERTISED AND THAT SUCH PLANS BE ORDERER SUBMITTED TO THE STATE HIGHWAY COMMISSION ALONG WITH OTHER EVIDENCE AS REQUIRED BY THE RULES AND REGULATIONS OF THE STATE HIGHWAY COMMISSION.

BE IT RESOLVED that the County Treasurer be authorized to deposit funds in excess of the capital and surplus in any depository designated for county funds, provided such depository furnish the proper securities as provided by law, and that the Treasurer be and she hereby is, authorized to invest surplus funds, if there be any, in United States Treasury bills or certificates of deposit in the following financial institutions: First Nebraska Bank, Decatur, First National Bank Northeast, Tekamah, and Washington County Bank, Tekamah.

All of the Burt County Supervisors are on the Burt County Weed Board.

Upon motion by Schold, seconded by Brummond, the Board approved special designated liquor licenses for Ronnie’s Bar at St Patrick’s Catholic Church for Lenten fish fry dinners on February 20, February 27, March 6, March 13, March 20 and March 27, 2015, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers and T.Connealy. Nays – none.

Upon motion by T.Connealy, seconded by Schold, the Board approved an annual cost of living raise based on the Midwest Economic Consumer Prices available January 16, not to exceed 3%, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers and T.Connealy. Nays – none.

Highway Superintendent Smith discussed the 1 and 6 Year Road Plan with the Board. Allen Soll came before the Board to visit with Smith and the Board to request to keep Airport Road in the County Road Plans.

Upon motion by M.Connealy, seconded by Schold, the Board authorized Chairman Morrow to sign the Burt County Weed Control Authority Activities and Information Report, with roll call vote as follows: Ayes – Morrow, Schold, Brummond, M.Connealy, Rogers and T.Connealy. Nays – none.

Board Member T.Connealy briefly reported information on the lease of a tractor for the possible replacement of an existing County Tractor.

Discussions followed regarding the possible formation of a Road Committee, no action was taken at this time.

There being no further business to come before the Board at this time, the Board adjourned at 10:20 A.M. until 9:00 A.M. January 30, 2015.

The meeting opened at 9:00 A.M. upon motion by Rogers, seconded by Newill, with roll call vote as follows: Ayes – Morrow, Newill, T. Connealy, Rogers, M. Connealy, Brummond and Schold. Nays – none. Chairman Morrow informed the public that the Nebraska Open Meeting Act was posted on the wall.

The status of various road projects was discussed with Highway Superintendent Peggy Smith and Road Foreman Mike Braniff. While discussing County Road O east of Highway 77, Jonathan Hladik addressed the Board about the condition of that road.

Becky and Marty Rocca voiced concerns over ditches and water flow on County Road 39 and County Road Q.

David Drew informed the Board that a pending law suit against the County and S.T.T.L. Farms LLC brought by Ivan Marr has been dismissed, and discussed the possibility of further actions that could be taken against the County.

The minutes of the last meeting were approved upon motion by Newill, seconded by Rogers, with roll call vote as follows: Ayes – Morrow, Newill, T. Connealy, Rogers, M. Connealy, Brummond and Schold. Nays – none.

Communication from Larry Dix was notated and placed on file.

Upon motion by M. Connealy, seconded by T. Connealy, the Board approved an amendment to Burt County’s Flexible Benefit Plan with First Concord Benefits Group, allowing employees to revoke their elections to the group health insurance premium and seek coverage elsewhere under certain conditions. Roll call vote was as follows: Ayes – Morrow, Newill, T. Connealy, Rogers, M. Connealy, Brummond and Schold. Nays – none.

Upon motion by Newill, seconded by T. Connealy, Deborah Anderson was appointed to the Burt County Economic Development Board, with roll call vote as follows: Ayes – Morrow, Newill, T. Connealy, Rogers, M. Connealy, Brummond and Schold. Nays – none.

Upon motion by Schold, seconded by M. Connealy, the Board designated Burt County’s website as an additional method of providing notice of meetings, with roll call vote as follows: Morrow, Newill, T. Connealy, Rogers, M. Connealy, Brummond and Schold. Nays – none.

There was discussion about the problems with the current employee health insurance plan through NACO and Blue Cross Blue Shield. Chairman Morrow informed the Board that he had visited with Larry Dix and that a NACO Services Representative would be attending the January 13 meeting.

Chairman Morrow signed the following lot split applications:
James D. Kroger located in the Southeast Quarter of Section 11, Township 22 North, Range 9 East of the 6th PM, Burt County, Nebraska.
Kevin and Dawn Anderson Family Limited Partnership located in the Southeast Quarter of Section 6 and the Southwest Quarter of Section 5, Township 22 North, Range 10 East of the 6th P.M., Burt County, Nebraska.
John C. Hall Trust located in the Southeast Quarter of the Southeast Quarter of Section 36, Township 21 North, Range 11 East and in the Southwest Quarter of the Southwest Quarter of Section 31, Township 21 North, Range 12 East of the 6th P.M., Burt County, Nebraska.

John Wilson brought a list of the 2015 Burt County Extension Board nominees for the Board’s approval. Upon motion by Brummond, seconded by Schold, the Board approved Stuart Miller for a second term and Karin Preuss and Rob Mayo as new board members, with roll call vote as follows: Ayes – Morrow, Newill, T. Connealy, Rogers, M. Connealy, Brummond and Schold.

Mary Loftis spoke to the Board about the work she has been doing with the Medicare Prescription Drug Program, as well as the other programs she works with and the education she has received and continues to receive through the SHIPP program. She estimates that she saved people enrolling in the prescription drug coverage $104,000.00 last year alone. Mary has been asked to be the State Coordinator for the Medicare Prescription Drug Program and that will take a couple extra days each year for additional training. The Board congratulated her and expressed their gratitude for the work she does to help the people of Burt County, saying they support her in her new position.

On this 30th day of December, 2014 let it be hereby resolved that the Burt County Board of Supervisors expresses their deepest gratitude to our County Clerk Marge Shumake and our County Attorney Dan Smith for jobs well done and that we wish them only the best as they retire from serving the citizens of Burt County.

Marge has served for 22 years. She has been Deputy Clerk and then Clerk, and Dan has served for 15 years as our County Attorney. The Board has relied on both of them heavily for assistance and counsel and they have made our jobs easier because of their abilities. We heartily congratulate them both and wish them well in their future endeavors.

Motion was made by Schold, seconded by M. Connealy, to appoint Ted Connealy to the Northeast Nebraska Community Action Partnership (NENCAP) Board, with roll call vote as follows: Ayes – Morrow, T. Connealy, Rogers, M. Connealy, Brummond and Schold. Nays – none.

Discussion followed with Highway Superintendent Smith and Road Foreman Braniff regarding conditions of roads, status of projects, and the future need to replace a tractor and possible purchase of a snow blower.

The Burt County Board of Supervisors met this date pursuant to adjournment of their last meeting with the following members present: Cliff Morrow, Gerald Newill, Perry Rogers, Matt Connealy and Dave Schold. Absent: Ted Connealy and Greg Brummond.

The meeting opened at 9:00 A.M. upon motion by Schold, seconded by Newill, with roll call vote as follows: Ayes – Morrow, Newill, Rogers, M. Connealy and Schold. Nays – none. Chairman Morrow informed the public that the Nebraska Open Meetings Act was posted on the wall.

Upon motion by Newill, seconded by Rogers, the agenda was approved, with roll call vote as follows: Ayes – Morrow, Newill, Rogers, M. Connealy and Schold. Nays – none.

Visiting the Board were Mark Jackson, Peggy Smith, Mike Braniff and Rex Sears.

Letter from the Nebraska State Bar Association and email from Wellness Partners LLC were noted and placed on file.

The Board discussed various roads and projects with Highway Superintendent Peggy Smith and Road Foreman Mike Braniff.

Rex Sears visited with the County Board regarding County Government Day. He indicated that the American Legion may not be receiving funding for the lunch provided that day and asked if the County would be willing to cover the lunch expense should the Legion not receive the funding from the Nebraska National Guard next year.

Upon motion by Newill, seconded by M. Connealy, the Board agreed to pay for the lunch expense up to an amount of $500.00 should the funding from the State fall through, with roll call vote as follows: Ayes – Morrow, Newill, Rogers, M. Connealy and Schold. Nays – none.

Board Member Rogers offered the following resolution and moved for its adoption:

WHEREAS, the official holidays for the year 2015 need to be approved by the Burt County Board of Supervisors.

Upon motion by Newill, seconded by M. Connealy, the Board authorized Chairman Morrow to sign the Certification of County Highway Superintendent, with roll call vote as follows: Ayes – Morrow, Newill, Rogers, M. Connealy and Schold. Nays – none.

Schold moved to change the date of the first meeting in December to Monday, December 8, 2014, and to set the public hearing for STTL Farms LLC at 1:00 P.M. so the hearing could be held in the County Court Room. M. Connealy seconded the motion, with roll call vote as follows: Ayes – Morrow, Newill, Rogers, M. Connealy and Schold. Nays – none.

Highway Superintendent Peggy Smith talked to the Board about purchasing safety clothing for the Road crew. Fluorescent colored sweatshirts and t-shirts were discussed as well as vests.

Motion was made by M. Connealy, seconded by Schold, to purchase sweatshirts now and t-shirts later as needed for safety purposes, with roll call vote as follows: Ayes – Morrow, Newill, Rogers, M. Connealy and Schold. Nays – none.

At 10:00 the Chairman declared the Board of Equalization in session. County Assessor Joni Renshaw read the following tax list correction:

Michael Zarogoza, Sr. $606.12 tax accelerated (mobile home being moved)

At 10:01 the Board went back into regular session. Upon motion by M. Connealy, seconded by Rogers, the tax list correction was approved, with roll call vote as follows: Ayes – Morrow, Newill, Rogers, M. Connealy and Schold. Nays – none.
