Burt County Board of Supervisors Meeting Minutes


The Burt County Board of Supervisors met April 29, 2014, pursuant to adjournment of their last meeting with the following members present:  Cliff Morrow, Gerald Newill, David Schold, Perry Rogers, Matt Connealy, Greg Brummond and Gene Rollins.

 

The meeting opened at 9:00 A.M. upon motion by Rollins, seconded by Newill, all voting aye.  Chairman Morrow informed the public that the Nebraska Open Meeting Act was posted on the wall.

 

Upon motion by Connealy, seconded by Rogers, the agenda was approved with the addition of possible action on the Elm Creek project, all voting aye.

 

Visiting the Board were Peggy Smith, Mike Braniff, Carroll Welte, Dan Smith, Joni Renshaw, Kevin Brenneis, Bill Cook, Scott Japp, Kevin Petersen, Dave Ferro, Sarah Chatt, John Hundahl, Kay Petersen and Jennifer Sievers.

The minutes of the last meeting were approved upon motion by Connealy, seconded by Schold, all voting aye.

 

Communication from DHHS regarding the Federal Fiscal year 2012 Incentive Payment was noted and placed on file.

 

Chairman Morrow signed a lot split application for Kevin and Klarise Brummond located in the S ½ of Section 25, Township 22 North, Range 11 East of the 6th P.M., Burt County, Nebraska.

 

Chairman Morrow signed a lot split application for Kevin Loftis located in the N ½ of the NW ¼ of Section 19, Township 21 North, Range 10 East of the 6th P.M., Burt County, Nebraska.

 

Chairman Morrow signed the contract with Luxa Construction Company for the Burt County Road O Project.  Luxa had the low bid, which was accepted at the Board’s April 8, 2014, meeting.

 

Burt County Highway Superintendent Peggy Smith presented a road study on Public Road #468, as well as one on Public Roads #312 and #320, to the Board as part of the process to close the roads.

 

Carroll Welte came before the Board with bids for a new phone system in the Courthouse.  The low bid was from American Broadband at $21,746.00, but it contained a warranty fee of $250.00 per month.  With the life of the phone system expected to be ten to fifteen years, this fee put their bid at the high end instead of the low end.  Huntel Communications brought in a bid at $24,850.00, and TeleSystems, LLC’s bid was for $26,560.00.

 

Motion was made by Brummond, seconded by Rogers, to accept Huntel’s bid in the amount of $24,850.00, all voting aye.

 

At 10:00 A.M. Highway Superintendent Smith opened motor grader bids.  Nebraska Machinery Company submitted the only bids.  The bids to replace two motor graders with trade-ins were $94,200.00 and $77,781.00.  After considerable discussion, Rogers moved to accept both bids.  Rollins seconded the motion, with roll call vote as follows:  Ayes – Newill, Schold, Rogers, Connealy and Rollins.  Nays – Brummond.

 

Kevin Brenneis presented his 2014 Annual Insurance Report and answered questions.

 

Bill Cook from the Concrete Council talked to the Board about the advantages of pouring concrete on county roads.

 

Scott Japp discussed the NRD’s Integrated Management Plan with the Board.

 

Carroll Welte came before the Board again to discuss a new phone contract with American Broadband and the cost to bring fiber optic construction to the Courthouse.  The proposal for the monthly phone bill, including long distance and upgrades for the new voice over IP system for the Courthouse, is $1,183.28.  The one-time cost to bring fiber optic to the Courthouse is $5,000.00.

 

Motion was made by Connealy, seconded by Schold, to accept the new phone contract with American Broadband in the amount of $1,183.28 per month, all voting aye.

 

Motion was made by Connealy, seconded by Brummond to pay American Broadband $5,000.00 to bring fiber optics into the Courthouse, all voting aye.

 

Board Member Connealy offered the following resolution and moved for its adoption:

 

RESOLUTION #2014-09

 

WHEREAS, the Road Fund is in need of funds to operate.

 

NOW THEREFORE BE IT RESOLVED by the Burt County Board of Supervisors that $200,000.00 be transferred from the General Fund to the Road Fund per the Burt County budget document for fiscal year 2013-2014.

Board Member Schold seconded the motion, and the Chairman declared it adopted, all voting aye.

 

Upon motion by Newill, seconded by Rogers, the Board authorized Chairman Morrow to sign an agreement between Burt County and the State of Nebraska for highway improvement projects, as they pertain to land survey corners, all voting aye.

 

Replacing two Freightliner trucks purchased in 2011 was discussed.

 

The Elm Creek Bridge Project was also discussed.  On motion by Connealy, seconded by Rollins, the Board approved hiring Valley Electric for $8.00 a linear foot to place drain pipe on each side of the bridge, all voting aye.

 

Upon motion by Connealy, seconded by Newill, the Board approved a Special Designated Liquor License for Pheasant Bonanza for a beer garden at their Warrior Dash to be held on June 7, 2014, all voting aye.

 

Upon motion by Schold, seconded by Brummond, the Board approved a Special Designated Liquor License for Ronnie’s Bar to have a beer garden at the rodeo on June 6 and June 7, 2014, all voting aye.

 

County Attorney Smith shared an offer made to Burt County by Wells Fargo to donate the property located at 100 S Park Ave in Oakland to Burt County.  After it was mentioned that the City of Oakland received the same offer, the Board chose to do nothing and let Oakland accept the property if they so choose.

 

Veterans Service Officer Penny Warren informed the Board that the Veterans Service Committee had accepted the resignation of Harold Palmer and they are looking for a replacement from the Lyons area.  She also asked for the approval of Ed Hanna to serve another term.  Rogers moved to approve another term for Ed Hanna, and Schold seconded the motion, all voting aye.

 

At 11:49 A.M. Chairman Morrow declared the Board of Equalization in session.  County Assessor Joni Renshaw read the following tax list correction:

OCE Financial      $60.78 tax deducted

 

At 11:51 A.M. the Board went back into regular session.  Upon motion by Newill, seconded by Schold, the tax list correction was approved, all voting aye.

 

Sheriff Pickell was unable to appear before the Board regarding the 911 system due to the Board’s full agenda and his duties as Sheriff, so that will be rescheduled.

 

There being no further business to come before the Board at this time, the Board adjourned at 11:55 A.M. until 9:00 A.M. May 14, 2014.

The meeting opened at 9:00 A.M. upon motion by Rollins, seconded by Newill, all voting aye.  Chairman Morrow informed the public that the Nebraska Open Meeting Act was posted on the wall.

 

Upon motion by Connealy, seconded by Schold, the agenda was approved as amended with the addition of the Elm Creek Bridge drains, all voting aye

 

Visiting the Board were Peggy Smith, Mike Braniff, Katie Novak, Carroll Welte, Penny Warren, Michele Quick, Roland Richards, Dale Johnson, Roger Moderow, Marty Peterson, Travis Mann, and a representative from A & R Construction.

 

Carroll Welte visited with the Board about the necessity of recabling the Courthouse for both telephone and data and answered questions.

 

Welte then presented the following two bids to the Board for updating the computer network wiring to CAT 6 in the Courthouse:

TeleSystems LLC           $45,775.00

Fremont Electric Inc      $96,160.00

 

Upon motion by Schold, seconded by Brummond, the Board accepted the TeleSystems LLC bid in the amount of $45,775.00, all voting aye.

 

There was considerable discussion regarding three bids for a new Voice Over IP Telephone System for the Courthouse.  These bids will be studied further, and a decision will be made at the next Board Meeting on April 29.

 

The County Clerk Report of Fees, the County Court Report of Fines, the District Court Fee Report and the Zoning Report for March, as well as the Sheriff’s Quarterly Reports, were approved upon motion by Rogers, seconded by Newill, all voting aye.

 

The minutes of the last meeting were approved upon motion by Rogers, seconded by Schold, all voting aye.

 

Miscellaneous Receipts in the amount of $510,810.53 and fund balances were approved upon motion by Connealy, seconded by Rollins, all voting aye.

 

Correspondence from Larry Dix, NACO, in regard to regional meetings on health insurance was discussed and placed on file. Cliff Morrow and Peggy Smith will attend the meeting.

 

Correspondence from the Merrick Foundation regarding a project for the Nebraska Sesquicentennial in 2017 was discussed and placed on file.

 

At 10:30 A.M. County Highway Superintendent Peggy Smith opened the following sealed bids for the construction of 0.323 miles of roadway grading and paving on County Road O:

Luxa Construction         $372,694.00         Start Date-July 1, 2014

Sawyer Construction     $393,078.06         Start Date-May 12, 2014

A&R Construction                   $490,052.50         Start Date-May 12, 2014

 

Board Member Connealy moved to accept the low bid of Luxa Construction in the amount of $372,694.00, and Schold seconded the motion, all voting aye.

 

After clarification by Highway Superintendent Smith as to location of roads to be closed, Connealy offered the following two resolutions and moved for their adoption:

 

RESOLUTION #2014-07

 

WHEREAS, the Burt County Board of Supervisors may deem it in the public interest to vacation or abandonment of a public road #465 located in Section 19, Township 20, Range 11E of the Sixth P.M.

 

AND WHEREAS, the Burt County Board of Supervisors directs the County Highway Superintendent to study the use being made of such public road and to submit in writing to the County Board within thirty days, a report upon the study made and her recommendation as to the vacation or abandonment thereof.

 

NOW THEREFORE BE IT RESOLVED by the Burt County Board of Supervisors that said study and report be done.

RESOLUTION #2014-08

 

          WHEREAS, The Burt County Board of Supervisors may deem it in the public interest to vacation or abandonment of public roads #312 and #320 located in Section 23, Township 21, Range 11E of the Sixth P.M.

 

AND WHEREAS, the Burt County Board of Supervisors directs the County Highway Superintendent to study the use being made of such public road and to submit in writing to the County Board within thirty days, a report upon the study made and her recommendation as to the vacation or abandonment thereof.

 

NOW THEREFORE BE IT RESOLVED by the Burt County Board of Supervisors that said study and report be done.

Board Member Schold seconded the motion, and the Chairman declared it adopted, all voting aye.

 

Connealy moved to authorize a contract with Sta-Bilt Construction Company for ten days of work cleaning and filling roadway cracks, at which time they will contact County Highway Superintendent Smith with the amount of work done and the amount of the bill to determine whether or not to have them continue.  The motion was seconded by Rogers, all voting aye.

 

There was discussion concerning drains at the Elm Creek Bridge, and Smith will talk to the engineers on the project.

 

There being no further business to come before the Board at this time, the meeting adjourned at 10:50 A.M. until 9:00 A.M. April 29, 2014.

Board Member Rogers seconded the motion, and the Chairman declared it adopted, all voting aye.

 

Road Superintendent Peggy Smith approached the Board in regard to closing two roads – one is County Road A just off of Hwy 75, and the other is    3 ¾ miles east of Tekamah on County Road GH.  After discussion, Smith was instructed to begin the process of closing these two roads.

 

Upon motion by Schold, seconded by Rogers, Chairman Morrow was given approval to sign a contract for the Oakland NW Project, all voting aye.

 

Chairman Morrow signed a lot split application for Mary Ann Prussa located in the NE ¼ of the SE ¼ of Section 26, Township 21 North, Range 11 East of the 6th P.M., Burt County, Nebraska.

 

Upon motion by Connealy, seconded by Newill, the Board approved a request to hold the annual National Day of Prayer Service on the courthouse grounds on May 1 at 12:00 P.M., all voting aye.

 

Upon motion by Schold, seconded by Brummond, the Board approved a Special Designated Liquor License for Silver Hills Vineyards & Winery for Saturday, August 9th, 2014, all voting aye.

 

Upon motion by Newill, seconded by Schold, the Board approved a Special Designated Liquor License for the Burt County Fair for August 1 through August 5, 2014, all voting aye.

 

At 10:00 A.M. Chairman Morrow opened the public hearing on the Application for Conditional Use Permit by Ronald Keogh, requesting permission to install a wind turbine on the SW ¼ of the SW ¼ of Section 5, Township 21, Range 9, Burt County, Nebraska.  After discussion, the Chairman declared the public hearing closed at 10:10 A.M., and the Board went back into regular session.

 

Upon motion by Newill, seconded by Brummond, the application for the installation of a wind turbine was approved, all voting aye.

 

At 10:12 A.M. Chairman Morrow declared the Board of Equalization in session.  County Assessor Joni Renshaw read the following tax list corrections:

Robert E. Coffman         $474.34 tax added

Martin Long                             $509.02 tax deducted

 

At 10:15 A.M. the Board went back into regular session.  Upon motion by Brummond, seconded by Rollins, the tax list corrections were approved, all voting aye.

The Burt County Board of Supervisors met March 11, 2014, pursuant to adjournment of their last meeting with the following members present: Clifford Morrow, Gerald Newill, David Schold, Perry Rogers, Matt Connealy, Greg Brummond and Gene Rollins.

The meeting opened at 9:00 A.M. upon motion by Rollins, seconded by Newill, all voting aye. Chairman Morrow informed the public that the Nebraska Open Meeting Act was posted on the wall.

Upon motion by Connealy, seconded by Rollins, the agenda was approved, all voting aye.

Visiting the Board were Peggy Smith, Mike Braniff, Katie Novak and Chris Aldman.

The County Clerk Report of Fees, the County Court Report of Fines, the District Court Fee Report and the Zoning Report for February were approved upon motion by Rogers, seconded by Newill, all voting aye.

The minutes of the last meeting were approved upon motion by Rogers, seconded by Schold, all voting aye.

Miscellaneous Receipts in the amount of $113,373.36 were approved upon motion by Schold, seconded by Connealy, all voting aye.

Correspondence from the Nebraska Information Technology Commission regarding the FirstNet Project was discussed and placed on file. FirstNet is an effort to build a nationwide broadband network for first responders. Matt Connealy will serve as the County Board’s representative to speak with First Net.

Chairman Morrow signed a lot split application for Howard Buffet located in the SW ¼ of Section 35, Township 22N, Range 11E of the 6th P.M., Burt County, Nebraska.

Highway Superintendent Peggy Smith advised the Board that Burt County can rent a skid loader from NMC for one full year or 250 hours for $5,500.00. Highway Foreman Mike Braniff stated that it would be a 257 or 259 track skid loader. Upon motion by Rogers, seconded by Brummond, the Board voted to rent the skid loader from NMC for $5,500.00, all voting aye.

At 10:00 Highway Superintendent Peggy Smith opened the following bids for the bridge northwest of Oakland on County Road L.
Dixon Construction $757,177.50 with July start date
Theisen Construction $559,247.26 with June 10 start date

Connealy moved to accept the low bid with Theisen Construction in the amount of $559,247.26. Rogers seconded the motion, all voting aye.

There being no further business to come before the Board at this time, the Board adjourned at 10:05 A.M. until 9:00 A.M. March 28, 2014.

Upon motion by Rogers, seconded by Brummond, the Board authorized Chairman Morrow to sign a contract with Knife River Midwest LLC for County Road 3 in the amount of $704,549.80, all voting aye.

 

Highway Superintendent Peggy Smith presented an agreement with the Nebraska Department of Roads for the inspection and any necessary load re-rating of all fracture critical bridges in Burt County due for inspection in 2014, at an estimated cost of $3,000.00 for the Chairman to sign.  The County pays just 20 per cent of the $3,000.00, or $600.00.

 

Board member Connealy offered the following resolution and moved for its adoption.

SIGNING OF A PROGRAM AGREEMENT

FOR 2014 FRACTURE CRITICAL BRIDGE INSPECTIONS

Whereas:  the Nebraska Department of Roads (NDOR) is developing a transportation project, on the behalf of the county, for which it intends to obtain Federal funds;

 

Whereas:  Burt County as a sub-recipient of Federal-Aid funding is charged with the responsibility of expending said funds in accordance with Federal, State and local laws, rules, regulations, policies and guidelines applicable to the funding of the Federal-aid project;

 

Whereas:  Burt County and the NDOR wish to enter into a Program Agreement to provide for fracture critical bridge inspection and load re-rating (if necessary) services for the Federal-aid project.

 

Be it Resolved:  by the Board of Supervisors of Burt County, Nebraska that:

 

Cliff Morrow, Chair of the Burt County Board of Supervisors is hereby authorized to sign the attached Program Agreement between Burt County and the NDOR.

At 10:07 A.M. the Board went into Board of Equalization for the Motor Vehicle Exemption Hearing.  County Treasurer Karen Grass stated that the three exemptions were renewals and had her recommendation.  As there were no objections or comments, the Board went back into regular session at 10:09 A.M.

The County Clerk Report of Fees, the County Court Report of Fines, the District Court Fee Report and the Zoning Report for January were approved upon motion by Rogers, seconded by Connealy, all voting aye.

 

The minutes of the last meeting were approved upon motion by Rogers, seconded by Brummond, all voting aye.

 

Miscellaneous Receipts in the amount of $577,419.73 were approved upon motion by Schold, seconded by Newill, all voting aye.

 

Highway Superintendent Peggy Smith brought the Board up to date on the progress on the drainage analysis on County Road P.

 

Chairman Morrow reported to the Board that the amount the County currently pays for burials of $1,650.00 is not covering the cost that the funeral home incurs for a county burial.  Many counties only offer cremation, and if Burt County chooses to go to cremation only, it would not be necessary to raise the cost of county burials.  This issue will be on the agenda for the February 27, 2014 meeting, and the Board will vote on limiting county burials to cremation at that time.

 

The possibility of naming Arizona Cemetery and Silver Creek Cemetery as Pioneer Cemeteries was discussed.  Ray Petersen was in attendance, representing the Tekamah Cemetery District, and stated that the District would be willing to mow the two cemeteries, thereby eliminating the need for the County to declare them abandoned and maintain them.  Lloyd Olson spoke for the Arizona Cemetery, stating that they would be satisfied if the Tekamah Cemetery District would mow the Arizona Cemetery and would not pursue having it considered an abandoned cemetery.  Phyllis Rieken, who submitted the petition for the Silver Creek Cemetery, was not in attendance.  The Board considered the issue settled.  If the Silver Creek Cemetery representatives are not content with the agreement wherein the Tekamah Cemetery Board agrees to mow their cemetery, they will have to approach the Board again at a later date.

 

Nico Hardeman was in attendance with questions regarding when the County would hard surface County Road V near Hardsteel, citing the repair costs he has incurred due to dust from the road.  The cost and durability of pavement and asphalt were discussed, as well as the possibility of getting asphalt from the same company that will be resurfacing Highway 75 at a reduced rate.  This project is on the 1 and 6 Year Road Plan, and the possibility of borrowing from the Inheritance Tax Fund in order to move it up to this year was also discussed. Highway Superintendent Smith said part of the engineering has already been done and she will ask for the rest to be completed before the Board makes a final decision.

 

There being no further business to come before the Board at this time, the Board adjourned at 10:43 A.M. until 9:00 A.M. February 27, 2014.

The Burt County Board of Supervisors met January 30, 2014, pursuant to adjournment of their last meeting with the following members present:  Cliff Morrow, Gerald Newill, David Schold, Perry Rogers, Greg Brummond and Gene Rollins.  Absent: Matt Connealy.

 

The meeting opened at 9:00 A.M. upon motion by Rollins, seconded by Newill, all voting aye.  Chairman Morrow informed the public that the Nebraska Open Meeting Act was posted on the wall.

 

Upon motion by Schold, seconded by Rollins, the agenda was approved, all voting aye.

The minutes of the last meeting were approved upon motion by Schold, seconded by Newill, all voting aye.

 

Glen Schuetze advised the Board that Stalp Gravel would have very little gravel to sell this year, but quoted the following prices for what they may have:

$11.75 per ton to Oakland (down-haul)

$12.00 per ton to Tekamah (down-haul)

 

Chairman Morrow signed a lot split application for Paul Chamberlain located in the SW1/4 of Section 13, Township 20 North, Range 10 East of the 6th P.M., Burt County, Nebraska.

 

Board Member Rogers offered the following resolution and moved for its adoption:

 

RESOLUTION #2014-02

 

       WHEREAS, the Road Fund is in need of funds to operate.

 

NOW THEREFORE BE IT RESOLVED by the Burt County Board of Supervisors that $200,000.00 be transferred from the General Fund to the Road Fund per the Burt County budget document for fiscal year 2013-2014.

Board Member Schold seconded the motion, and the Chairman declared it adopted, all voting aye.

 

Upon motion by Schold, seconded by Rollins, the Board authorized Chairman Morrow to sign letter to Ritterbush & Piotrowski regarding the audit they performed for Burt County on fiscal year 2012-2013, all voting aye.

 

Upon motion by Brummond, seconded by Rollins, the Board approved the following special designated liquor licenses, all voting aye.

Ronnie’s Bar at St Patrick’s Catholic Church for Lenten fish fry dinners                      on March 7, March 14, March 21, March 28 and April 4, 2014;

Silver Hills Vineyards & Winery for a wedding on May 31, 2014;

Silver Hills Vineyards & Winery for a class reunion on May 24, 2014.

 

 

At 10:00 A.M. Highway Superintendent Peggy Smith opened the following bids for resurfacing County Road 3:

At 10:26 A.M. Chairman Morrow opened the hearing for the One and Six Year Road Plan.  After questions and input from the public, the hearing was closed at 11:06 A.M., and the Board went back into Regular Session.

 

Board Member Brummond offered the following resolution and moved for its adoption:

          WHEREAS, PURSUANT TO L.B. 1302 OF THE 80TH LEGISLATURE OF THE STATE OF NEBRASKA, A PUBLIC HEARING WAS HELD BY THE BURT COUNTY BOARD OF SUPERVISORS FOR THE PURPOSE OF DRAFTING A ONE AND SIX YEAR ROAD PLAN TO DESIGNATE SPECIFIC ROAD AND BRIDGE IMPROVEMENTS FOR BURT COUNTY ROADS.

 

WHEREAS, LEGAL NOTICE WAS PUBLISHED IN THE BURT COUNTY OAKLAND INDEPENDENT WHICH IS THE LEGAL NEWSPAPER IN THE COUNTY.

 

          BE IT FURTHER RESOLVED, THE ONE AND SIX YEAR ROAD PLANS WERE FULLY DISCUSSED BY THE HIGHWAY SUPERINTENDENT WITH THE COUNTY BOARD AND THOSE PRESENT.

 

NOW THEREFORE BE IT RESOLVED BY THE BURT COUNTY BOARD OF SUPERVISORS THAT THE ONE AND SIX YEAR ROAD PLANS FOR ROAD IMPROVEMENTS IN BURT COUNTY BE APPROVED AS PRESENTED BY THE HIGHWAY SUPERINTENDENT AND AS ADVERTISED AND THAT SUCH PLANS BE ORDERED SUBMITTED TO THE STATE HIGHWAY COMMISSION ALONG WITH OTHER EVIDENCE AS REQUIRED BY THE RULES AND REGULATIONS OF THE STATE HIGHWAY COMMISSION.

Board Member Rollins seconded the motion, and the Chairman declared it adopted, all voting aye.

 

Highway Superintendent Smith notified the Board that she had received several complaints regarding someone fencing off County Road GH, a minimum maintenance road, so he could pasture both sides of the road since there was water on only one side of the road. The Board discussed the issue and consulted Deputy County Attorney Frank Barron regarding any county liability, but did not establish a policy for blocking minimum maintenance roads.  The owner of the cattle will be given two weeks to remove the fences from the road.

 

There being no further business to come before the Board at this time, the Board adjourned at 11:35 A.M. until 9:00 A.M. February 11, 2014.
